Section 13
Deciding on the disqualification of a candidate
: (1) When the nomination of a candidate for a member has been registered but the election result has not been declared, if anyone feels that a candidate is or has been disqualified, a complaint can be filed before the Commission through the relevant election officer with clear evidence on the matter. .
(2) If a complaint is received in accordance with sub-section (1), the election officer may request an explanation in this regard by giving seven days to such candidate.
(3) After receiving the explanation as per sub-section (2) or if the explanation is not received within the deadline, the election officer shall send the complaint as per sub-section (1) and the related documents to the Commission as soon as possible.
(4) After receiving the documents with the complaint according to sub-section (3), the Commission may, if it wishes, understand the relevant candidate or other bodies or authorities or request additional evidence.
(5) The Commission shall examine the documents including the complaint received from the election officer according to sub-section (3) and make a decision regarding the disqualification of the candidate within seven days from the date of receipt of the complaint.
(6) According to sub-section (5), the procedure to be adopted while deciding on the disqualification of the candidate shall be as determined by the Commission.
(7) Notwithstanding anything else written in this section, the operation of such election shall not be affected solely because the commission has not made a decision regarding the disqualification of a candidate in accordance with this section.
